Chapter 388-06 WAC

RCW 9.97.020(4)(a) mandates rulemaking by the department regarding the inclusion of certificates of restoration of opportunity (CROP) as part of reports, letters, or other assessments, and the application of a CROP to the state abuse and neglect registries. The rules add language to explain when a CROP will be a part of such assessments and when they are not required, and clarify and update the definitions related to the background check central unit of the department and its processes.

WAC 388-03-160, 114(2)

The Department is amending chapter 388-03 WAC to clarify the beginning date of acceptable interpreter continuing education credits (CEC) in WAC 388-03-160, and to correct the typographical error “processional” to “professional” in WAC 388-03-114(2).

WAC 388-03-030, 060, 124

The department is updating chapter 388-03 WAC with the following changes: 1. Add the definition of "Language Specialist" to WAC 388-03-030; 2. Delete "Per the nature of services LAPL provide to department clients, they are treated as department position cluster 5 employees and are certified as such." from the definition of "Licensed agency personnel (LAPL)" in WAC 388-03-030; 3. Delete the second occurrence of the word "employees" in WAC 388-03-060(2); and 4. Repeal WAC 388-03-124.

Chapter 388-03 WAC

The purpose of the rule and its amendment is to establish the process and procedures in implementing the goals of RCW 74.04.025 - To certify/authorize spoken language interpreters/translators to ensure quality services to limited-English proficient clients; Title VI of the Civil Rights Act of 1964 - To prohibit discrimination against recipients of Federal funded programs; and 45 CFR Section 80.3(b)(2) – To require "recipients" of Federal financial assistance from HHS to take reasonable steps to provide meaningful access to Limited English Proficient (LEP) persons. Without the rule and its amendment, program policies cannot be enforced; nor can program policies withstand any legal challenge.

Chapter 388-06 WAC

The purpose of this coordinated rulemaking is to move DSHS employee background check requirements into a separate rule chapter, chapter 388-06B WAC. This filing also permanently adopts emergency rules filed under WSR 14-21-062. This rulemaking is intended to comply with federal and state law and to provide clarity for the affected individuals and hiring authorities.

Chapter 388-06 WAC

The purpose of this coordinated rulemaking is to move Children’s Administration background check requirements from chapter 388-06 WAC, Sections 0010 through 0260, to chapter 388-06A WAC. Under a separate CR-103, Children’s Administration will create chapter 388-06A and permanently adopt Children’s Administration background check rules. This rulemaking is intended to resolve confusion and misapplication of program-specific background check requirements that exist because Children’s Administration programmatic background check requirements are contained in the rule chapter for department-wide background check requirements.
