The Division of Child Support (DCS) intends to amend sections in chapter 388-14A WAC dealing with the annual fee imposed on certain child support cases to implement section 4 of Engrossed Substitute House Bill 1916 (Chapter 275, Laws of 2019).  This legislative change was based on federal requirements under Title IV-D of the Social Security Act. DCS is amending WAC 388-14A-2200 “When does DCS charge a twenty-five dollar annual fee on a child support case?” and WAC 388-14A-2205 “How can a custodial parent be excused from payment of the annual fee?”, and may amend or repeal other related rules as required.

The Division of Child Support (DCS) intends to amend WAC 388-14A-3903 “How does DCS decide whether to petition for modification of a support order?” and other related rules as may be required in order to implement §§ 2 and 3 of Engrossed Substitute House Bill 1916 (ESHB 1916, Chapter 275, Laws of 2019), which takes effect on July 28, 2019. At the same time DCS files this Preproposal Statement of Inquiry, DCS is filing a CR-103E, Rule-Making Order, to adopt an emergency amendment of WAC 388-14A-3903; that emergency rule will implement the bill while DCS goes through the regular rulemaking process under chapter 34.05 RCW. DCS may make additional changes to the modification criteria that will allow for greater flexibility for child support order modifications; as part of this rulemaking process, DCS may amend or repeal existing sections, or may adopt new sections, in chapter 388-14A WAC.

The department is planning to amend sections in chapter 388-14A WAC in order to streamline procedures regarding the use of a form called the Notice to Payee. The Division of Child Support (DCS) uses the Notice to Payee to do the following: 1) Provide notice to a custodial parent when DCS serves a Notice of Support Debt or Notice of Support Owed to establish the amount of back support debt or proportionate share of expenses owed by a noncustodial parent; or 2) Provide notice to a noncustodial parent when DCS serves a Notice of Support Owed to establish the amount of back support debt or proportionate share of expenses owed by a custodial parent. In order to carry out this rulemaking project, the department may also amend, repeal, or adopt other related sections of chapter 388-14A WAC as may be required.
